A DoorDash driver has been indicted in New York state accused of filming and posting a TikTok video of a passed out naked customer — who she claimed sexually harassed her.
Olivia Henderson, 23, appeared in Oswego District Court on Friday after a grand jury voted to move forward with criminal charges connected to the viral video she recorded during childbirth in 2025.
Through her lawyer, Henderson pleaded not guilty, according to the British Daily Mail News Channel 9. She was released while the case continues, and is scheduled to return to court in June.
The indictment stems from an incident on Oct. 12, 2025, in which prosecutors said Henderson recorded a man sleeping on his couch without pants by filming through his front entrance, then shared the clip on TikTok.
The video, which shows the man inside his home, quickly went viral, reaching nearly 30 million views before it was removed.
Court documents accuse Henderson of “humiliating” the victim by recording “intimate parts of such person at a place and time where such person had a reasonable expectation of privacy, without such person’s knowledge or consent.”
Henderson claimed the encounter amounted to sexual harassment and filed a police report after the video was posted.
“My client asked to leave my order at their front door, and when I arrived at their house, their front door was wide open, and they were within sight of the front door, lying on the couch, inappropriately exposed to me,” she said in the TikTok video.
But investigators later determined that the man passed out drunk inside his home and did not interact with Henderson.
She was subsequently arrested and charged with one count of second-degree unlawful surveillance and one count of disseminating a first-degree unlawful surveillance image.
Henderson made his first court appearance in December 2025 in Oswego City Court, where a video of the proceedings went viral on social media.
At Friday’s hearing, Oswego County Judge Armen Nazarian did not allow cameras in the courtroom.
Henderson declined to comment when contacted by reporters outside court.
DoorDash previously said its account was disabled after the incident.
“Posting a video of a customer at their home, and publicly revealing their personal details, is a clear violation of our policies,” the company said.
“This is the only reason why this Dasher account, along with the customer account, was deactivated during the investigation.”
Henderson remains free without bail as the case progresses.
If convicted, she faces up to eight years in prison.
